Authorize Bureau of Transportation to acquire certain temporary property rights necessary for construction of the SE Stark St: 111th - 151st Ave Project through the exercise of the City’s Eminent Domain Authority
通俗摘要
City can take temporary use of land for SE Stark crossing work
This lets the transportation bureau get temporary rights to use parts of private property near SE 119th Ave and SE Stark St so it can build new curb ramps for wheelchairs and a safety island for people crossing the street. The city will try to agree on a fair price with owners first. If they cannot agree, the city can use eminent domain, which means going to court to get the rights and have a judge set fair payment.
Decision: Passed, 12 to 0.
Who it affects: Owners of the property near SE 119th Ave and SE Stark St, and people who walk, roll or cross the street along SE Stark.
Money: The cost of the property rights is not known yet because talks with owners are not finished. An estimate is set aside in the city's transportation budget for 2026-2027.

通俗摘要
City may use eminent domain for temporary access on SE Stark Street
This lets the city get temporary rights to use parts of private property so it can build safety upgrades at SE 119th Ave and SE Stark St. Eminent domain is the city's legal power to take property rights for public use, as long as it pays owners a fair price. The city will try to agree on payment with owners first, and can go to court if they cannot agree.
Decision: Moved to a second reading. No vote is listed yet.
Who it affects: Owners of the affected properties near SE 119th Ave and SE Stark St, plus people who walk, roll or drive in that area.
Money: The cost of the property rights is not known yet because talks with owners are not finished. Money for this phase is set aside in the city's transportation budget for 2026-2027.
Next: Second reading on October 7, 2026 at 9:30 am.

- Purpose and background
- The City of Portland may exercise the power of eminent domain pursuant to Section 9-108 of the City Charter and in accordance with Eminent Domain procedures provided for in ORS Chapter 35 (Eminent Domain; Public Acquisition of Property), including those procedures that apply to notification, valuation, negotiation, relocation and early possession if necessary, when the exercise of such power is deemed necessary by the City Council to accomplish public purposes for which the City has responsibility. The City of Portland has the responsibility of providing safe transportation routes for commerce, convenience and to adequately serve the traveling public. The SE Stark St: 111th - 151st Ave Project (the "Project") will construct improved ADA compliant curb ramps, pedestrian crossing islands, enhanced signing and striping, and updated drainage and utility components. For this segment at SE 119th Ave. and SE Stark St., the project will build new ADA curb ramps and a pedestrian refuge island to provide a safer, more accessible crossing for community members. To accomplish the Project set forth above, it is necessary to acquire the following property interests described and depicted in Exhibits 1 through 4, attached to this Ordinance and, by this reference incorporated herein. All affected property owners have been contacted and informed as to the City's need for certain private property rights related to completion of the Project. All affected property owners have been invited by mailing to attend the reading of this agenda item.
- Financial and budgetary impacts
- Property values associated with the property rights acquisitions have not yet been quantified since negotiations are not completed; however, an estimate for the right of way phase has been budgeted in the Transportation Operating Fund. The level of confidence for the estimate is moderate. Funds are available in the General Transportation Revenue Fund 200000 Budget, FY 2026-2027 Budget, SAP # T01103. This legislation does not affect staffing levels or result in a new or modified financial obligation or benefit now or in the future. If City Council does not approve the ordinance, construction of the Project will not be feasible as planned, due to lack of property rights needed to make the improvements.
- Economic and real estate impacts
- Not applicable.
- Community impacts and community involvement
- PBOT carried out an 18-month public engagement process in 2019–20, gathering input through an online survey and in person discussions with community members along the Stark Street corridor. This outreach highlighted concerns about speeding, unsafe crossings, gaps in sidewalk and transit access, and the need for better visibility along the corridor. These priorities helped shape the project's focus on building safer pedestrian crossings and improving accessibility. PBOT continues to share updates and engage the public through community events and neighborhood meetings and encourages residents to sign up for notifications, and coordinates with neighbors and corridor stakeholders as the project advances.
- 100% renewable goal
